Terms of Service and User Agreement

Welcome to FastKYC, the digital documentation and verification platform operated by Pentafox Technologies Private Limited (CIN: U72900TN2016PTC104233), a company registered under the Companies Act, 2013, India, with its registered office at 3rd Floor, Jeyam Towers, opposite Nalli Hospital Road, Municipal Colony, Muncipal Colony, Erode, Tamil Nadu 638004

Pentafox Technologies Private Limited (including “FastKYC”) is hereinafter referred to as “Company,” “we,” or “us.”

The individual or entity using the website (www.fastkyc.com), the services made available on the site, or related applications, tools, plugins, extensions, or APIs (collectively, the Services), is hereinafter referred to as the “User,” “Customer,” or “you.”

The Company and the User are collectively referred to as the Parties and individually as a Party

By accessing or using any of our Services, you agree to be bound by, and comply with, these Terms of Service in their entirety. If you do not agree, you must not use the Services.

1. About the Services

FastKYC provides Software and services for paperless documentation, which include, but are not limited to, the generation, facilitation, management, storage, sharing, digitization, validation, and verification of documents and user identity (the Services).

2. Acceptance and Updates to Terms

These Terms are effective as of the Last updated date above. We reserve the right to update these Terms at any time. It is your responsibility to frequently check this page for updates. Your continued use of the Services after any changes are published constitutes your acceptance of the revised Terms.

User Rights and Responsibilities

2.1 User Rights

  • You may subscribe to all or part of the Services offered by the Company.
  • You can discontinue/cancel/unsubscribe from your subscription/account for any or all Services at any time.
  • Note: The Company is not liable to refund any fees paid for the discontinued Service(s).
  • You have complete ownership rights over your Content submitted to the platform.
  • You may unsubscribe from promotional communication at any time. However, you cannot opt out of essential transactional or informational communications necessary for Service delivery.

2.2 User Responsibilities and Conduct

  • You are responsible for all Content submitted.
  • The Content does not violate any third-party rights, including Copyright or Trademark.
  • The Content is free from viruses, trojans, malware, or malicious scripts.
  • You will maintain the security and confidentiality of your access credentials (username/password). You agree to notify the Company of any unauthorized use immediately or security breach.
  • You will use only trusted and secure devices and networks to access your account.
  • You will not use the Services to upload, post, or transmit any unlawful, harmful, threatening, abusive, defamatory, or otherwise objectionable content.
  • You will not violate any applicable local, state, national, or international law.
  • You will indemnify the Company against any third-party claims or actions arising solely from your breach of these Terms or violation of law.

Company Rights and Responsibilities

3.1 Company Rights

  • We reserve the right to discontinue or limit any free services at any time.
  • We can automatically renew your subscription based on the subscribed plan if not cancelled by you, and in such cases, no refund will be processed.
  • We may terminate a session, change access credentials, or prevent content submission if suspicious activity or malware is detected on your account or in your Content.
  • We have the right to publish, quote, or cite your organization's name/logo (as an existing User) for marketing and advertising purposes without prior written consent.

3.2 Company Responsibilities

  • We are responsible for the security of the Site and associated systems.
  • We will deliver the Services to the best possible standard and strive to maintain the highest possible Service uptime.
  • We are responsible for performing periodic upgrades and maintenance and shall communicate any scheduled service downtime to you.
  • We are responsible for maintaining the Privacy of User and Content as outlined in the separate Privacy Policy.
  • We will provide you with Invoices and Receipts for all fees paid.

Intellectual Property (IP)

4.1 Ownership of Content

The Company does not claim ownership rights to any documents or files you submit to the platform (Content). These Terms grant us only limited rights (including copying, storing, and verifying) necessary to provide the Services to you and in accordance with our Privacy Policy.

4.2 Company IP

You acknowledge that all rights, title, and interests in the Site, the Services, the FastKYC name and logo, and all related Intellectual Property (IP) are solely owned by Pentafox Technologies Private Limited or its licensors.

  • You are granted a limited, non-exclusive, non-transferable license to use the Services for personal and/or approved business use.
  • You agree not to copy, modify, reverse engineer, decompile, or create derivative works of the Site or Services.

5. Legal Provisions

5.1 Third-Party Content and Links

Our Services may display or link to third-party products, services, or websites (Third Party Content). We do not control, endorse, or guarantee the accuracy or quality of such content and are not responsible or liable for any damage or loss caused by your reliance on it.

Digital India Logo Note: We are not directly associated with the Digital India campaign. Use of the logo represents alignment with the vision but does not imply endorsement, approval, or affiliation by the Government of India.

5.2 Disclaimer of Warranties

YOUR USE OF THE SERVICES IS AT YOUR SOLE RISK. The Services and the Content are provided on an AS IS and AS AVAILABLE basis. To the maximum extent permitted by law, we expressly disclaim all warranties, including implied warranties of MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, and NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted or error-free.

5.3 Limitation of Liability

To the maximum extent permitted by applicable law, the Company, its suppliers, and licensors will not be liable for any indirect, incidental, special, consequential, or exemplary damages, including damages for loss of profits, goodwill, use, or data, arising from your use of the Services.

Our total liability for any claim arising out of or related to your use of the Services will not exceed the amounts, if any, that you have paid to us for your use of the Services.

5.4 Governing Law and Jurisdiction

This Agreement is governed by the laws of India. All disputes, claims, and actions arising out of this Agreement will be subject exclusively to the jurisdiction of the competent courts at Delhi, India. You specifically waive any right to challenge this exclusive jurisdiction.

5.5 Term and Survival

The term of this Agreement is coterminous with your usage of the Site and/or Services. Clauses relating to IP, Indemnity, Liability, and Governing Law shall survive the termination or expiration of this Agreement.
